1. Introduction & Acceptance of Terms
Welcome to Onigifts.com (the “Site”). These Terms of Service (“Terms”) govern your access to and use of the Site, operated by Cassie Renee LLC (“Onigifts,” “we,” “us,” or “our”), and the purchase of apparel and related products (“Products”) offered through the Site.
By accessing the Site, creating an account, browsing, or purchasing Products, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms incorporate by reference our Privacy Policy, Shipping Policy, and Refund & Return Policy. If you do not agree with these Terms or any incorporated policy, please do not use the Site or purchase our Products.

Onigifts grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for your personal, non-commercial purposes, strictly in accordance with these Terms. You agree not to use the Site for any illegal purpose or in any way that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of it.
3. Accounts
To access certain features of the Site, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Onigifts immediately of any unauthorized use of your account or any other security breach.
4. Product Information, Availability, and Made-to-Order Nature
We aim to display accurate Product information on the Site, including descriptions, materials, sizing, pricing, and images. However, we do not guarantee that all information is completely accurate, current, or error-free. Product colors may vary depending on your screen settings.
Made-to-Order: Please be aware that Onigifts Products are created specifically for you (“made-to-order”) through our trusted production partners after you place your order. This process allows us to offer unique designs and minimize waste. Estimated production times are detailed in our Shipping Policy.
Availability: All Products are subject to availability, which may change without notice. We reserve the right to limit the quantity of Products purchased, reject all or part of an order, or discontinue Products at our discretion.
Pricing Errors: If a Product is listed at an incorrect price due to a typographical error or other mistake, Onigifts reserves the right to refuse or cancel any orders placed for that Product at the incorrect price, even if the order has been confirmed and payment processed. If payment has already been made, we will promptly issue a credit to your original payment method for the amount of the incorrect price.
5. Orders, Payment, and Order Acceptance
Placing Orders: When you place an order on our Site, you are making an offer to purchase the selected Product(s) according to these Terms.
Payment: You agree to provide current, complete, and accurate purchase and account information for all orders. By providing payment information, you authorize us (or our third-party payment processor) to charge your selected payment method for the total order amount, including the price of the Product(s), applicable taxes, and shipping fees (if any).
Order Confirmation: You may receive an email acknowledging receipt of your order after it is placed. This email is only a confirmation of receipt and does not signify our acceptance of your order.
Order Acceptance: We reserve the right to accept or reject your order in our sole discretion. Acceptance of your order occurs only when we ship the Product(s) or send a specific confirmation email stating that your order has been accepted and is being processed for shipment. We may require additional verification or information before accepting any order.

This policy provides details on our made-to-order production times, shipping methods (including our use of providers like USPS, UPS, DHL), estimated delivery timeframes, shipping costs (if applicable), tracking information, and policies regarding international shipments (including customs and duties). The risk of loss and title for Products purchased pass to you upon our delivery of the items to the shipping carrier.

In no case shall Onigifts, Cassie Renee LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the site or any products procured using the site, or for any other claim related in any way to your use of the site or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the site or any content (or product) posted, transmitted, or otherwise made available via the site, even if advised of their possibility. 13. Governing Law and Jurisdiction
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to principles of conflict of laws. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the federal or state courts located in Kern County, California, United States, and you irrevocably consent to the jurisdiction and venue of such courts.
14. Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms and any policies or operating rules posted by us on this Site or in respect to the Service (including the Privacy Policy, Shipping Policy, and Refund & Return Policy) constitute the entire agreement and understanding between you and Onigifts and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
